By downloading, accessing, or using the YearBuilt mobile application (the "App"), you agree to be bound by these Terms of Service and End User License Agreement ("Terms"). These Terms constitute a legally binding agreement between you and MyLuminaCircle LLC, a Virginia limited liability company ("Company", "we", "us", or "our"). If you do not agree to these Terms, do not use the App.
1. App Usage and Licensing
MyLuminaCircle LLC grants you a personal, revocable, non-exclusive, non-transferable license to use YearBuilt for personal, educational, or professional discovery purposes. You may not reverse-engineer, scrape, decompile, or attempt to extract the underlying database, source code, or augmented reality functionality.
2. Subscription and Scan Credit Terms
YearBuilt operates on a consumable credit system. Purchasing a package grants you a specific allotment of scan credits. A scan credit is consumed and deducted from your balance only when a successful 'Year Built' data point is delivered to a user.
Expiration and Non-Transferability: Purchased scan credits expire 24 months after purchase or upon account deletion, whichever comes first. Credits are strictly non-transferable and hold no real-world cash value.
Refunds and Chargebacks: Because the App utilizes the Apple App Store and Google Play Store for in-app purchases, all transactions are subject to the respective platform's billing and refund policies. MyLuminaCircle LLC cannot process direct refunds. Any fraudulent chargebacks may result in the immediate suspension or termination of your account and forfeiture of credits.
Cancellation: If the App introduces recurring subscriptions, you may cancel at any time through your Apple or Google account subscription settings. Cancellations take effect at the end of the current billing cycle.
3. Safe and Lawful Use (AR Features)
You agree to remain fully aware of your physical surroundings while using the augmented reality features of YearBuilt. You agree not to use the application while driving, walking in traffic, or operating machinery. Furthermore, you agree not to trespass on private property, violate local privacy laws by pointing the device camera at individuals or viewing the interiors of private residences, or harass property owners while scanning.
4. Property Information Accuracy Risk (Data Disclaimer)
The historical construction dates displayed in YearBuilt are aggregated from public records and authorized third-party data providers.
Not for Official Use: The information provided by YearBuilt is strictly for informational, educational, and architectural research purposes. It should NOT be used as the sole basis for formal real estate appraisals, property valuations, legal boundary disputes, inspections, or financial transactions. Public records can contain errors, delays, or omissions. MyLuminaCircle LLC does not independently verify property dates and makes no warranties regarding the absolute accuracy or completeness of the data. Users (including realtors, contractors, inspectors, and home buyers) must independently verify property details.
5. Limitation of Liability and Warranty Disclaimer
Disclaimer of Warranties: To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, accurate, or uninterrupted.
Limitation of Liability: To the maximum extent permitted by law, in no event shall MyLuminaCircle LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill arising out of your use of the App, incorrect property information, service outages, loss of scan credits, physical injury, or property damage. Our aggregate liability shall not exceed the greater of (a) $100 USD or (b) the amount paid by you during the preceding twelve months.
6. Indemnification
You agree to indemnify, defend, and hold harmless MyLuminaCircle LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights (including property trespassing or privacy rights).
7. Platform Providers (Apple and Google)
You acknowledge that these Terms are between you and MyLuminaCircle LLC, not with Apple Inc. or Google LLC.
Third-Party Beneficiary: Apple and Google and their subsidiaries are third-party beneficiaries of these Terms.
Maintenance and Support: Neither Apple nor Google have any obligation to provide maintenance or support services.
Warranty & Claims: MyLuminaCircle LLC (not Apple or Google) is solely responsible for addressing user claims, product liability, and third-party intellectual property infringement claims.
Legal Compliance: You represent and warrant that you are not located in a U.S.-embargoed country or listed on any U.S. Government list of prohibited or restricted parties.
8. DMCA / Copyright Complaint Process
We respect the intellectual property rights of others. If you believe your copyright has been infringed by content on the App, please submit a written DMCA notice to our Designated Copyright Agent at contact@yearbuilt.app. Your notice must include: (1) a physical or electronic signature of the copyright owner; (2) identification of the infringed work; (3) identification of the infringing material; (4) your contact information; (5) a statement of good faith belief; and (6) a statement of accuracy under penalty of perjury.
9. Dispute Resolution
These Terms shall be governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
Before initiating any formal legal proceeding, you agree to contact MyLuminaCircle LLC at contact@yearbuilt.app and make a good-faith effort to resolve the dispute informally.
Except for claims that may be brought in small claims court or claims seeking injunctive relief to protect intellectual property or other proprietary rights, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.
To the maximum extent permitted by law, you and MyLuminaCircle LLC agree that any claims will be brought only in an individual capacity and not as part of a class action, collective action, or other representative proceeding.
If any portion of this Section is found unenforceable, the remaining provisions shall remain in full force and effect.
